The Delhi High Court granted permission for the medical termination of pregnancy beyond the 24-week statutory ceiling.
In a critical judicial decision emphasizing reproductive rights and survivor trauma, the Delhi High Court has permitted a 17-year-old minor rape survivor to terminate her 29-week-long pregnancy.

The single-judge bench arrived at the decision after evaluating the comprehensive report submitted by a duly constituted medical board at a premier state-run hospital, which assessed both the physiological and psychological ramifications of carrying the pregnancy to full term.

Prioritizing Bodily Autonomy and Mental Health

Under India's Medical Termination of Pregnancy (MTP) Act, the general upper statutory threshold for aborting a pregnancy is capped at 24 weeks for specific vulnerable categories, including minors and survivors of sexual assault. Terminations beyond the 24-week limit necessitate constitutional court intervention and medical board clearance.

In its observations, the court emphasized that forcing a minor victim of sexual assault to carry an unwanted pregnancy resulting from violence causes irreparable physical and mental agony. The court underscored that a woman's right to reproductive choice and bodily integrity remains an integral dimension of personal liberty protected under Article 21 of the Constitution of India.

"The trauma of sexual violence is compound and ongoing when a survivor is compelled to carry the resulting pregnancy against her will," the bench noted during the proceedings, observing that the petitioner's welfare must take precedence.

Medical Board Findings and Protocol

Before delivering the order, the court had directed the medical superintendent of a specialized tertiary care hospital in New Delhi to form an expert medical panel comprising gynecologists, pediatricians, psychiatrists, and radiologists.

Key aspects addressed in the judicial directive include:

* Medical Clearance: The expert medical board confirmed that while medical termination at 29 weeks carries inherent surgical risks, continuing the pregnancy posed severe threats to the minor's mental and physical health. * Informed Consent: The court verified that both the minor and her legal guardians provided informed consent after understanding the risks involved in late-term medical intervention. * State Medical Support: The bench directed the hospital administration to ensure the procedure is conducted by senior medical specialists without imposing any financial burden on the survivor's family. * Preservation of DNA Evidence: In compliance with statutory requirements under the Protection of Children from Sexual Offences (POCSO) Act, the hospital was directed to preserve tissue samples and DNA evidence from the fetus to facilitate ongoing criminal proceedings against the accused.

Legal Precedents on Late-Term Abortions

The verdict aligns with consistent jurisprudence established by the Supreme Court of India, which has repeatedly reiterated that the 24-week ceiling under the MTP Act should not become an insurmountable barrier when the mental and physical health of a rape survivor is critically endangered.

Legal experts note that Indian courts have increasingly adopted a compassionate, rights-based approach toward survivors of sexual abuse, recognizing that socio-economic vulnerabilities and psychological shock frequently delay the discovery or reporting of pregnancies in minor victims.
