The Allahabad High Court has revoked the bail granted to a man accused of rape after he reneged on an undertaking to marry the victim, reiterating that judicial relief obtained under specific assurances cannot stand if those commitments are deliberately breached.

The single-judge bench took stern note of the accused's conduct after it emerged that conditional relief had previously been extended on the premise that the parties would formalize their relationship. Following his release from custody, the accused reportedly backtracked on the commitment, prompting the complainant to approach the court seeking immediate cancellation of his bail.

Court Slams Breach of Undertaking

During the proceedings, the bench observed that courts cannot be treated as a platform for obtaining liberty through hollow promises. The court noted that when an accused secures discretionary relief by extending a solemn undertaking to marry the complainant and subsequently resiles from that stance, it undermines the sanctity of judicial orders.

The prosecution and counsel for the victim submitted that the accused had misled the court to secure release from jail. Upon gaining freedom, the man and his family categorically refused to honor the arrangement, leaving the victim without legal recourse other than seeking the revocation of his bail order.

Taking into account the totality of circumstances, the High Court directed that the bail bond be cancelled immediately and ordered authorities to take the accused back into judicial custody.

Judicial Scrutiny Over Marriage-Linked Bail

Legal observers note that courts across India have increasingly scrutinized the practice of granting bail predicated on compromises or marriage proposals in serious criminal offenses, particularly rape under Section 376 of the Indian Penal Code (now governed under the Bharatiya Nyaya Sanhita).

Key aspects highlighted during the hearing include:

* Sanctity of Assurances: The bench observed that undertakings given before a court of law carry legal binding force and breach thereof constitutes an abuse of the court's process. * Custodial Enforcement: The court directed local law enforcement to ensure prompt arrest and return of the accused to jail. * Integrity of Trial: The bench noted that allowing the accused to remain at liberty after violating court-recorded conditions could adversely impact the trial and intimidate the complainant.

The High Court reiterated that serious criminal charges must be adjudicated on their factual and legal merits, and accused persons cannot exploit conditional interim relief to evade custody.
