The Enforcement Directorate (ED) has moved the Supreme Court of India to challenge the interim protection from coercive action previously granted to digital news portal NewsClick and its founder Prabir Purkayastha in connection with an alleged money laundering case.

The central financial probe agency filed a special leave petition contesting the relief granted by the Delhi High Court, which had restrained the agency from taking coercive measures against the media platform and its editorial leadership while directing them to cooperate with the ongoing investigation.

The Legal Challenge Before the Apex Court

In its plea before the top court, the Enforcement Directorate contended that interim protection orders impede the statutory authority of investigating officers under the Prevention of Money Laundering Act (PMLA), 2002. The agency argued that blanket protections hinder comprehensive custodial examination, which it deems necessary to uncover the intricate paper trail of overseas fund transfers.

Legal representatives for the agency maintain that the threshold requirements for obtaining interim relief under financial crime statutes must adhere strictly to established judicial precedents. The agency has sought an expedited hearing to vacate the protective shield and proceed with its inquiries unhindered.

Background of the Money Laundering Investigation

The ongoing scrutiny originates from an Enforcement Case Information Report (ECIR) registered by the federal agency, stemming from allegations of unlawful foreign remittances funneled into PPK Newsclick Studio Pvt Ltd. The ED claims the portal received substantial foreign direct investment and remittances that allegedly violated regulatory guidelines and foreign exchange norms.

According to federal investigators, funds routed through overseas entities were allegedly deployed to finance activities contrary to national regulatory frameworks. The media outlet has consistently denied all allegations of financial impropriety, asserting that all foreign funding was received transparently through legitimate banking channels in full compliance with Indian laws.

Arguments Over Investigative Protocol

NewsClick and its legal team have argued before various judicial forums that the continuous scrutiny constitutes an effort to stifle independent journalism and create a chilling effect on critical press coverage. Counsel representing the portal emphasized that the organization has consistently cooperated with summonses, submitted financial documents, and complied with all procedural inquiries.

The Delhi High Court had earlier extended interim protection while observing that the accused parties were participating in the inquiry and had not absconded. However, the agency's petition before the Supreme Court argues that financial investigations involving complex foreign transactions require unrestricted interrogation powers as envisaged by Parliament under the PMLA.

The Supreme Court is expected to take up the matter for consideration in the coming days, with the outcome likely to clarify the balance between pre-trial protective measures and the statutory mandate of financial enforcement agencies.
